You should carefully read the following Terms and Conditions. Your purchase or use of our products or services implies that you have read and accepted these Terms and Conditions.
License
ThemeSnap.com grants you non-exclusive limited license to use ThemeSnap.com created themes (CSS, custom theme images and/or graphics) and other products sold through our web site by independent content providers (the "Product(s)") in accordance with these Terms and Conditions (the "license"). See "Third-party HTML or Theme Designs" for other licensing information separate from ThemeSnap.com's themes or other products, as different licensing restrictions may apply.
GPL License Information
Drupal is open source and distributed under the GNU General Public License, version 2 or later. Therefore, any Drupal modules and certain theme files we might create, distribute, or "sell" from ThemeSnap.com will fall under this GPL license. Theme files could consist of, but are not limited to, files that "hook" into Drupal, i.e. the page.tpl, block.tpl, template.tpl, theme .tpl files, along with certain Javascript files or modules, among others. These types of files can be distributed freely after you purchase a theme and these files are not licensed files created by ThemeSnap.com but are instead part of Drupal and covered by Drupal's GPL license.
However, certain CSS file(s), theme files, images, and certain third-party files or code within our themes are or may be free-standing, independent files that are used by the web browser rather than executed by Drupal. Therefore, certain CSS file(s), theme's images, and other media files which may include Javascript code or other code used by our themes, are not automatically released under the same GPL license. Images, JavaScript, and flash files that PHP sends to the browser are not affected by the GPL because they are "data" and not part of Drupal itself.
Therefore, you must obtain ThemeSnap.com written permission to redistribute, in any format, any images, media, CSS files, and other files that make ThemeSnap.com themes distinctive and unique.
Third-party HTML or Theme Designs
ThemeSnap.com will, at times, purchase a full extended license or other licensing rights to resale third-party HTML designs, PhotoShop designs ("PSDs"), or other software on ThemeSnap.com. Certain ThemeSnap.com themes, PSDs, or other creative works or designs may be created by third-party contributors or designers. Therefore, some third-party licensing rights for themes sold from ThemeSnap.com may be restricted or may hold a different license altogether. If you have any questions regarding the usage of any product or theme sold on ThemeSnap.com, please contact us before purchasing that product by using the contact form on this website. Please reference the product in question.
Limited Use and Extended License Usage
You may use each single product purchased on one website owned and/or registered to you, the purchaser. You may also use each single product on one customer/client website that is not registered to you. Multiple client or customer website installations are not allowed with our products, i.e. you cannot install our product on more than one client/customer website. However, we do provide an extended license option that will allow you to use any ThemeSnap.com created theme on multiple client or customer websites. Please email us for more information or to receive the extended license purchase link and note the theme you're wanting to use the extended license on. You are prohibited to resale the product as a stand-alone item to any individual or third-party. See our Unauthorized Use section below for more details.
Unauthorized Use
You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from ThemeSnap.com. You may not resell our products from any website as your own or from any other online or offline medium. Any resale of out products will result in an immediate DMCA notice to Google, your hosting provider, and immediate legal action from ThemeSnap.com.
Modifications
You are authorized to make any necessary modification(s) to our products to fit your or your client's purposes. This includes making modifications to Drupal, Drupal theming files, PHP, JavaScript, HTML and CSS files distributed with our products. However, please note that once you make changes to the product, it voids your product support since troubleshooting and debugging can only be performed on a new or unaltered version of our product(s). You are still free to post your questions or issues after customizing your product(s) in the ThemeSnap.com support forums as other customers or the ThemeSnap.com support team may still be willing to assist you after you've modified your product(s).
Assignability
You may not sub-license, assign, or transfer any theme license from any product sold by ThemeSnap.com to anyone else without prior written consent from ThemeSnap.com.
Ownership
You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of ThemeSnap.com or their respective owners. If you want to remove the footer link to ThemeSnap.com, please contact us through the contact form on our website to explain the situation. We're pretty open with this type of request.
Return Policy
Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall ThemeSnap.com be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages, or other losses arising out of the usage of or the inability to use our products.
Since ThemeSnap.com is offering non-tangible, irrevocable goods we do not issue refunds after the product is shipped/downloaded, which you are responsible for understanding upon purchasing. Please make sure that you've carefully read all relevant documentation, viewed the product demo(s), and asked any questions about the product before purchasing. We will only make exceptions with the return policy when/if the product appears to be not-as-described, on a case by case basis, and in agreement with the parties concerned. The maximum amount of time for any refund claim is within 7 days after the purchase date. Please allow up to 24 hours for a claim response.
If you are unsure about any of our products, please ask for a demo of the theme you're interested in and we'll set up access for you for that theme before you decide to purchase.
Third-party Module Support
Our themes are tested with the modules (JavaScript, etc.) that make them function as in the demos provided. Drupal has thousands of modules available and we cannot possibly test our themes with each and every module. It's just not humanly possible. If there are any issues with a Drupal module used in one of our themes, we will do everything we can to fix it promptly. However, third-party module maintainers may need to adapt a fix for their particular module used in our themes in order to work through any issue(s). This includes any third-party module, JavaScript, or other code the we specifically do not manage ourselves.
If you install other modules not included in the theme you purchased, we are limited to what we can provide for support and may, in fact, not be able to offer support at all for these situations as the problem could exist within the third-party module itself, your upgrade steps, or hosting environments.
Installation Profile Instructions and Terms
ThemeSnap.com themes come with an installation profile. This type of installation package is common for custom themes and combine core Drupal, contributed modules, themes, and pre-defined configuration into one download. This eliminates the manual setup and configurations that would be needed to set up custom themes such as the ones we sell. Our profile installations, when executed and completed, set up the necessary Views, content types, blocks, and other theme functions used in our custom products.
By purchasing a theme from ThemeSnap.com, you must understand the way in which profile installations are used to build our custom themes -- as a starting point and to set up your purchased theme just like our demo themes. Our profile installations set up all necessary Drupal modules and Drupal core. These "distributions" that enable and configure Drupal and a set of modules that work together are the basic functionality of a profile installation. If you need more information on how a profile installation works, please ask us before purchasing one of our products.
Since we utilize profile installations for our themes, it is up to you to set up or find adequate hosting for your theme. Because of wildly different server and hosting configurations, we cannot be held responsible for Aegir, localhost, Pantheon, Acquia Dev setup, Amazon AWS, or other server-side or "unique" or "special" configurations that may not be 100% compatibile with our themes, installation profiles, or that may use installation or configurations not compatible with all Drupal distributions (there are many!).
We do not support localhost installations such as MAMP, WAMP, or Xampp because there is no way we can replicate an individual's localhost environment or an Apache web server's configurations. We cannot log into a local machine or environment and/or troubleshoot the issue. Please install any of our themes on a live hosting environment versus localhost for reporting bugs. If the bug appears in a live hosting environment -- one we can log in to test and evaluate ourselves -- then we can try to solve the issue(s). Otherwise, you'll need to research your own particular localhost installation and configurations to troubleshoot.
Option: You can always set up one of our themes on a live hosting environment and then move it to localhost after the live setup completes.
Extent of Support for our Products
We only provide support for our themes or other products we may sell -- although we will make every attempt to provide assistance to minor non-theme related issues whenever possible or as time permits. However, due to the amount of options with theming and the thousands of third-party contributions available to Drupal, we cannot provide assistance with free, minor, or extensive modifications, or general Drupal website development, tutorials, or customizations.
We also may require website access to troubleshoot problems or to resolve any bugs that we cannot reproduce on our own. Without access to research the issue, we can provide little help. Technical support and theme bug fixes take first priority over non-technical support or bug related issues or requests. If you'd like help with customizations, please visit our paid support ticket area for more information or an estimation for your modifications or project.
Upgrading, patching, and version changes are all essential parts of any open source CMS such as Drupal. While we provide every effort to provide adequate change logs and file fixes for important updates or bug fixes, sometimes updating may not be an easy process for some customers. New, third-party module versions released could pose some upgrade restrictions that only a seasoned Drupal programmer will understand when implementing. Therefore, we do not provide free support for upgrades with third-party modules that are beyond our control and it's up to the customer to upgrade their own ThemeSnap.com theme based on the information we may provide for such upgrades or ones that become available through updated contributed Drupal modules or Drupal core versions.
After purchasing a product or theme from ThemeSnap.com, you are free to modify it to your or your customer or client's needs. However, once you alter the product, support for that product from ThemeSnap.com is void. We will only troubleshoot or fix a product or theme if the issue, error, or notice can be shown to us on an unaltered, clean installation of the theme or product. Modifications can be made, but please note this important policy on how it will void support time and help from ThemeSnap.com.
IMPORTANT: It is crucial that you make backups before making changes to your Drupal theme or Drupal installation on any live or staging environment. If you lose your content, theme changes, or make other modifications that alter your theme, we may not be able to help.
We do have a paid support section (http://support.themesnap.com/home) but we do not provide free support where we may have to spend time troubleshooting what a customer has modified.
Support Hours
Our support hours are currently between 9AM and 5:30PM EST Monday to Friday. Our response time may vary based on the volume of paid support or other requests we're handling at that time. Most requests will be addressed within 24 hours of receipt. Requests for free help will take longer for a response. We make every effort to provide assistance on weekends and non-business hours whenever possible.
Controlling Law and Jurisdiction
THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NORTH CAROLINA, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. YOU HEREBY AGREE AND CONSENT THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS LICENSE SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF NORTH CAROLINA.
ThemeSnap.com reserves the right to change or modify these and all other Terms or policies that are found on ThemeSnap.com at any time without prior notice.
