Important Information

You should carefully read the following Terms and Conditions. Your purchase or use of our products or services implies that you have read and accepted these Terms and Conditions.

License

ThemeSnap.com grants you non-exclusive limited license to use our themes (CSS, custom theme images and/or graphics) and other products sold through our web site by independent content providers (the "products") in accordance with these Terms and Conditions (the "license").

What's GPL'd, What Isn't?

Drupal is open source and distributed under the GNU General Public License, version 2 or later. Therefore, any Drupal modules and theme files we might create, distribute, or "sell" from ThemeSnap.com fall under this GPL license. Theme files could consist of, but are not limited to, files that "hook" into Drupal, i.e. the page.tpl, block.tpl, template.tpl files. and modules, among others. These types of files can be distributed freely after you purchase a theme and these files are not licensed files created by ThemeSnap.com but are instead part of Drupal's GPL.

However, certain CSS file(s) and theme images within our themes are free-standing, independent files that are used by the web browser rather than executed by Drupal. Therefore, this CSS file(s), theme's images, and other media files such as Javascript code(s) used by our themes, are not automatically released under the same GPL license simply because they are sent from the server to a user's browser. Essentially, images, JavaScript, and flash files that PHP sends to the browser are not affected by the GPL because they are data.

Therefore, you must obtain our permission to redistribute the images, media, and CSS files that make our themes distinctive.

Limited Use Granted

You may use each individual product purchased on one website owned and/or registered to you, the purchaser. Multiple client website installations are not allowed with our products.

Modifications

You are authorized to make any necessary modification(s) to our products to fit your or your client's purposes.

Unauthorized Use

You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from ThemeSnap.com.

Assignability

You may not sub-license, assign, or transfer this license to anyone else without prior written consent from ThemeSnap.com.

Ownership

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of ThemeSnap.com. In particular, you agree to have a discrete link to ThemeSnap.com on the template/website. You cannot claim ownership as a design company or individual by placing a link showing "designed by [your company/individual name]" since you are clearly using a theme designed by ThemeSnap.com. To claim ownership, the CSS files, images, and other products of ThemeSnap.com would have to be completely unrelated or the CSS and other files be completely different than our theme files at the time of purchase.

If you want to remove the footer link to ThemeSnap.com, please contact us through the contact form on our website to explain the situation. We're pretty open with this type of request.

Return Policy

Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

Since our company is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped/downloaded, which you are responsible for understanding upon purchasing. Please make sure that you've carefully read all relevant documentation and tried out the theme demos before purchasing. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is within 7 days after the delivery date.

** Note about Third-party Modules:

Our themes are tested with the modules, JavaScript, etc. that make them function as in the demos provided. Drupal has thousands of modules available and we cannot test our themes with each module. It's just not possible. If there are any issues with a core Drupal module or one of the modules shipped with our themes, we will surely do everything we can to fix it. However, if you install other modules not included in the themes, we are limited to what we can provide for support and may not be able to offer support at all for these situations.

Controlling Law and Jurisdiction

THIS LICENSE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NORTH CAROLINA, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. YOU HEREBY AGREE AND CONSENT THAT THE SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS LICENSE SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN THE STATE OF NORTH CAROLINA.

ThemeSnap.com reserves the right to change or modify these Terms at any time without prior notice.
